Terms of Service

The Booked Method ("we," "us," "our") is a brand of Element 7 Productions LLC, located at 10420 E Riverside Dr, Ste 201, Bothell, WA 98011. These Terms of Service ("Terms") govern your access to and use of bookedmethod.com (the "Site") and the services we provide. By using the Site, booking a call, or engaging our services, you agree to these Terms.

Who we are and what we do

We provide social media marketing services for home service businesses, including content strategy and production, paid advertising, lead capture and follow-up, and related reporting. Specific deliverables, fees, and terms for client engagements are set out in a separate written agreement between you and us. If that agreement conflicts with these Terms, the signed agreement controls for that engagement.

Eligibility and acceptance

The Site and our services are intended for businesses and for individuals who are at least 18 years old. By using the Site you represent that you meet these requirements and that any information you provide is accurate.

Bookings and communications

When you book a call or submit a form, you authorize The Booked Method to use the contact information you provide to respond to your inquiry by email or phone. Text messages will be sent only if you separately select the applicable optional SMS consent checkbox. Booking a call, submitting a form, or purchasing services does not require SMS consent.

Text messaging (SMS)

The Booked Method, a brand of Element 7 Productions LLC, offers separate marketing and non-marketing SMS programs. Depending on the optional checkbox or checkboxes you select, you may receive: (1) non-marketing messages about appointment scheduling, booking confirmations, appointment reminders, account updates, and replies to inquiries; and/or (2) marketing messages about our services, offers, and follow-up communications.

Message frequency varies. Message and data rates may apply. Consent to receive SMS is not a condition of purchase or booking. Reply STOP to any message to opt out. After you reply STOP, we may send a confirmation that you have been unsubscribed. Reply HELP for help, or contact hello@bookedmethod.com or (206) 905-8730. Carriers are not liable for delayed or undelivered messages. To re-enroll after opting out, complete the applicable opt-in process again. Please review our Privacy Policy.

Fees and payment

Fees for client services are described in your signed engagement agreement. Advertising spend billed by platforms such as Meta is paid by you directly to those platforms and is separate from our management fees. Except where required by law or stated in your agreement, fees are non-refundable.

Intellectual property

The Site and its content, including text, graphics, logos, and the names "The Booked Method" and "Element 7," are owned by us or our licensors and are protected by applicable laws. You may not copy, reproduce, or use our content or marks without our prior written permission. Ownership of deliverables produced under a client engagement is governed by that engagement agreement.

Acceptable use

You agree not to misuse the Site, including by attempting to disrupt it, gain unauthorized access, submit false information, or use it for any unlawful purpose.

Third-party services and links

We use third-party providers (for example, scheduling, CRM, email, analytics, and advertising platforms) and the Site may link to third-party websites. We are not responsible for the content or practices of third parties, and your use of their services is subject to their own terms.

Disclaimers

The Site and our services are provided "as is" and "as available." We do not guarantee any specific result, ranking, lead volume, or revenue outcome. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Element 7 Productions LLC and The Booked Method will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Site or our services. Our total liability for any claim relating to the Site will not exceed the amount you paid us, if any, for the service giving rise to the claim.

Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Washington, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update this page and the effective date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
